The regulation disqualifies the individual who is to head the management body of a business entity on five grounds: inclusion in the list of persons participating or suspected of participating in terrorist activity or the proliferation of weapons of mass destruction; being found legally incapable or of limited capacity; the currency of a court-imposed restriction on the right to carry on entrepreneurial activity; serving a sentence of imprisonment; and the passage of less than three years since a business entity they founded or headed was terminated through insolvency proceedings, unless the written-off tax debt has since been paid. None of this is asked on the form. The circumstances are established by integrating the corresponding information systems of the Ministry of Health, the Ministry of Internal Affairs, the Tax Committee, the Supreme Court and the Department for Combating Economic Crimes into the registration System, which is why a disqualification surfaces as an instant refusal rather than as a later problem.
